Psysig

Terms of Use

Effective

These Terms of Use ("Terms") govern your access to and use of psysig.org (the "Site"), operated by Psysig Research Corp ("Psysig," "we," "us"). By accessing or using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site. You must be at least 18 years old, or the age of majority where you live, to send us a submission.

The site

What this is

The Site publishes Psysig's studies, insights, and information about the lab. It is informational. Research findings are preliminary, studies marked in progress are incomplete, and any of it may be revised or withdrawn. Nothing on the Site is professional, legal, financial, medical, or technical advice, or an offer or commitment to deliver any product or service. Writing to us does not create a collaboration, client, or employment relationship. Work we do with you under a separate written agreement is governed by that agreement; if its terms conflict with these, the written agreement controls.

Citing our work

Quote us, with credit

You may quote reasonable excerpts from our studies and insights, and summarize or discuss them, for research, teaching, commentary, or journalism, provided you credit "Psysig Research" and link to the original page on the Site.

  • Do not republish a study or insight in full, or most of one, without our written permission.
  • Do not edit excerpts in a way that changes their meaning, or imply that we endorse you, your product, or your conclusions.
  • Do not sell our content or include it in a paid product.

Figures, quotations, and works by others that we cite remain the property of their owners and are subject to their terms.

Intellectual property

What belongs to us

Apart from the permission above, the Site and everything on it—text, design, the Psysig name and mark, figures, artwork, and underlying code—are owned by Psysig or its licensors and protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Site, or use our names or marks, without our prior written permission. All rights not expressly granted are reserved.

If you send us ideas or feedback, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.

Acceptable use

What you may not do

  • Scrape, crawl, or bulk-collect the Site or its content by automated means, or use any of it to train or evaluate machine-learning models. Search-engine indexing that follows our robots.txt is welcome.
  • Send us false, misleading, infringing, or abusive content, or impersonate another person or organization.
  • Probe, scan, or test the vulnerability of the Site, bypass its security, or access systems or data not intended for you. If you find a security issue, please email us promptly at legal@psyde.solutions.
  • Interfere with the Site's operation, including by sending excessive requests or malicious code.
  • Use the Site for anything unlawful or to infringe others' rights.

We may restrict or terminate access to the Site for anyone who violates these Terms.

Submissions

What you send us

When you email us you represent that the information you provide is accurate and that you have the right to share it. You keep ownership of your submission and grant us the right to use it to read and respond to it and to maintain our records. We respond selectively and are not obliged to reply.

Do not send confidential information, unpublished research, or unsolicited proprietary ideas unless we have agreed in writing to receive them; otherwise submissions are treated as non-confidential and we may pursue similar ideas without compensation or duty to you. By writing to us you agree that we may reply electronically; those messages satisfy any requirement that communication be in writing.

Third parties

Links and services

Our studies and insights cite and link to third-party papers, websites, and services we do not control. We are not responsible for their content, terms, or privacy practices. Our use of service providers is described in the Privacy Policy.

Disclaimers

As is

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that our research, data, or conclusions are complete, current, or correct. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.

Liability

Limits

To the fullest extent permitted by law, Psysig and its principals, employees, and collaborators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to the Site, its content, or these Terms, however caused. Your sole and exclusive remedy for any dissatisfaction with the Site is to stop using it. If we are nonetheless found liable, our total liability for all claims relating to the Site will not exceed one hundred US dollars (US$100). Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, willful misconduct, or gross negligence.

Any claim arising from or relating to the Site or these Terms must be brought within one year after it arises; claims brought later are permanently barred, to the extent the law allows.

Indemnity

Your responsibility

You agree to defend, indemnify, and hold harmless Psysig from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site or its content, or anything you send us.

Governing law

California

These Terms and any dispute arising from them or the Site are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and Psysig agree to the exclusive jurisdiction of the state and federal courts located in California and waive any objection to venue there. Either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.

California notice

Consumer notice

General

The rest

These Terms, together with the Privacy Policy, are the entire agreement between you and Psysig about the Site. If any provision is unenforceable it will be enforced to the maximum extent permitted and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. There are no third-party beneficiaries. We may modify, suspend, or discontinue the Site at any time without notice. Sections on citing our work, intellectual property, submissions, disclaimers, liability, indemnity, governing law, and this section survive any termination.
